OK, so I pre-order 5 cases thru them and they still haven't arrived. I was getting really good communication from the seller up until a few days ago when he was supposed to return my money. I'm just wondering if anyone else has had a similar experience and has any advice for me. I'm out over $400 right now, and I'm a little upset..

Yikes...did you pay with a Credit Card or with PayPal? If you still haven't heard back from them within the next week or so, I would file with your Credit Card company or with PayPal to get your funds returned. I've had to create files like that in PayPal a couple times, and they've been really easy to work with.

I would send and email to the person right away though and say that you are concerned that you haven't received any other communications, or your money, and that if you don't hear from them in X number of days, you're going to file with the Credit Card company.

That sucks man. Next time, order through one of our sponsors here. I did, and not only did I get the 2 cases I pre-ordered, I got them a day early!

Yeah, I was looking at the sponsor's site (free shipping.. but only in the states.. does Canada count ?:P) If shippings not too bad I will most likely put an order thru with them when the next set is out. After all, they sponsor a great site like this :) .

I used paypal, so filling a dispute is an option, I just don't know if I can since I paid oh so long ago.

How long ago was it? I think the general limitation on things is 6 months with PayPal, so if ordered anytime after July 10th or so, you should be OK. Plus, you could probably file the dispute and explain that it was a pre-order for an item released on November 16, and argue that your 6 months should start from when the item should have been shipped.

Just tried to open a dispute via paypal, and like I thought, the limit they impose is 45 days. Ouch, so no official channels for me. Hopefully I will be able to work things out.

I think you should be able to call customer service at PayPal and open a dispute anyways. Just a matter of talking to the right people.

Ah, that sucks. I guess being in Canada there isn't a toll-free number you can call? I think there's a 1-800 number for PayPal customer service here in the states.

Credit card dispute if you can go that way. I've had an Ebay scumbag pull that wait it out past the 45-60 days before and MBNA stepped right in. Score 1 for the little guy!!!

You need to file your dispute with Paypal within 45 days, regardless of whether the seller is promising to get the stuff to you. The scammers always try to sweettalk you until your time to file a greivance runs out, then they have your money and stop responding. You just tell the seller equally sweetly that your time is running out and you'll be perfectly happy to cancel the greivance procedures with PayPal as soon as you get what you're owed.

If you used a credit card you may have a bit longer but it's not always that much so call NOW.

Ruhk, the same thing has happened to me with 6 cases ordered. I'm past paypal's 45 days and mastercard & visa only have a 30 day dispute period. I have disputed the transaction anyway but mastercard tell me they can't guarantee my money back. I feel sick. Lesson learned - If a deal seems to good to be true it probably is!

Just for the record I am still waiting for an order I preordered with one of this site's sponsors. Luckily it was much smaller than yours. I gave up on them a month ago and ordered from someone else (my usual supplier).

Does anyone know of a legal precedence in these types of cases? I can understand that getting a lawyer involved is probably not worth the cost, but perhaps the threat of legal action may help. If anyone know anything about this, that would be a great.

Small Claims court costs you about $150 to start a claim and if you win, your opponent should cover all your court costs - which are pretty much the 150 unless you hire a lawyer - which you probably shouldnt unless you have a friend or relative.

Make sure you have all the necessary paperwork, receipts and communications and so forth and you should be fine. It takes a while sometimes, but relatively easy and fair.

Actually this is not entirely correct. If you did not receive the items that you ordered you should be able to file a dispute for non-receipt of merchandise. The 30 day time limit should not apply.

Not sure what bank your CC is with, but a good CSRep with a major bank should know all of that.

That is the advantage of using a CC.

Thanks for that information ChonChuuk. Pursued this further with the Credit Card company, supplied the required supporting evidence and I have received a full refund. :shock: Needless to say shan't be using ebay for presales again :maul:
